Terms of Service

These terms are the agreement between you and Passant LLC, 245 8th Ave #267, New York, NY 10011-1607, USA ("we", "us"), for using Passant. By using the app, you accept them. If you don't, don't use the app.

Your account

You need an invite code to join, and you must be at least 16. Keep your login details to yourself — you're responsible for what happens under your account. Give us accurate information, and don't impersonate anyone else.

You can delete your account at any time from the app.

What the app does, and what it doesn't promise

Passant logs your visits automatically and guesses which place you were at. It gets this wrong sometimes. It might name the restaurant next door, miss a stop entirely, or log somewhere you'd rather it didn't. That's the nature of working from phone location data. We give you tools to correct or ignore any visit, and we'd ask you to check anything that matters to you rather than treat the log as a record of fact.

Likewise, place details — addresses, opening hours, categories — come from third parties and may be out of date or wrong.

The app is provided "as is". We don't guarantee it will be available, uninterrupted, or free of bugs, and we may change or remove features.

Your content

Everything you create in Passant — your lists, comments, reactions, profile — stays yours. You give us permission to store it and show it to the people you've chosen to share it with, which is simply what's needed to run the app. That permission ends when you delete the content or your account.

You're responsible for what you post. Don't post anything you don't have the right to post.

Rules

Don't use Passant to:

• harass, threaten, or abuse anyone
• post illegal, hateful, or sexually explicit content
• share other people's private information, including their location
• impersonate someone else
• spam people, scrape the app, or use bots
• break into, overload, or reverse-engineer the service

We can remove content or suspend accounts that break these rules. For serious or repeated breaches we may do so without notice; otherwise we'll tell you why and you can reply.

Other people's privacy

Passant shows where you've been to people you approve. Be thoughtful about what you make public, especially where it reveals someone else's whereabouts alongside your own.

Liability

To the extent the law allows, we're not liable for indirect or consequential losses, lost data, or anything arising from your reliance on a visit or place being accurate. Nothing here limits liability for death, personal injury, or fraud, or any other liability that can't be excluded by law. If you're a consumer, your statutory rights are unaffected.

Money

Passant is currently free. If we introduce paid features, we'll set out the terms before you pay for anything.

Ending things

You can stop using Passant whenever you like. We can suspend or close your account if you break these terms, or if we discontinue the service — in which case we'll give you reasonable notice and a chance to export your lists.

Changes

We may update these terms. If a change is significant, we'll tell you in the app before it takes effect. Continuing to use Passant after that means you accept the new version.

Law

These terms are governed by the laws of the State of New York, USA, without regard to its conflict of law rules, and disputes go to the state and federal courts located in New York County, New York. If you're a consumer, you can also bring a claim where you live, and nothing here removes any right you have under the mandatory law of your home country.
